By accessing or using GetWhized ("Service," "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and subscribers.

You must be at least 13 years old to use GetWhized. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent. You may not use the Service if you have been previously banned or if applicable law prohibits you from doing so.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information. Notify us immediately at support@getwhized.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

GetWhized Auto uses artificial intelligence to generate content and financial analyses. AI-generated content may be inaccurate, incomplete, outdated, or inappropriate. You should independently verify any AI-generated content before relying on it, especially for medical, legal, financial, or safety-critical decisions.

GetWhized makes no warranty that AI-generated content is accurate, complete, or fit for any particular purpose. We are not liable for any decisions made based on AI-generated content.

The EV Savings Calculator, Financial Life Calculator, and any other financial tools are provided for informational and illustrative purposes only. They do not constitute financial advice. Results are estimates based on user inputs and assumptions that may not reflect real-world conditions. Consult a qualified financial advisor before making financial decisions.

You retain full ownership of the content you create, upload, or input into GetWhized Auto (broadcasts, saved vehicles, listings, etc.). By using the Service, you grant GetWhized a limited, non-exclusive license to store and process your content solely to provide the Service to you.

You are solely responsible for ensuring your content does not violate any third-party rights, applicable laws, or these Terms. We reserve the right to remove content that violates these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or extract source code from the Service
• Use automated bots, scrapers, or scripts to access the Service without permission
• Upload or transmit viruses, malware, or any malicious code
• Harass, abuse, or harm other users
• Generate, store, or distribute illegal, harmful, or offensive content
• Misuse the AI content generation features to create spam, misinformation, or deceptive content

GetWhized and its original content, features, branding, and underlying technology are owned by GetWhized and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our written permission.

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or availability of third-party services. Use of third-party services is subject to their respective terms and policies.

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We will make reasonable efforts to notify subscribers of significant changes. GetWhized is not liable for any downtime or service interruptions.

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms. Upon termination, your right to use the Service ceases. You may delete your account at any time by contacting support@getwhized.com. Provisions of these Terms that by nature should survive termination will do so, including ownership, disclaimers, indemnity, and limitation of liability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GETWHIZED DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, GETWHIZED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GETWHIZED IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless GetWhized and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California. You waive any objection to jurisdiction and venue in these courts.

Informal Resolution: Before filing a formal claim, you agree to contact support@getwhized.com and attempt to resolve the dispute informally for at least 30 days.

We may update these Terms at any time. We will notify you of material changes via email or a prominent notice in the app. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
